Judge: Disbarred D.A. Must Leave Now

DURHAM, N.C. (AP) -- Duke University has reached an undisclosed financial settlement with three former lacrosse players falsely accused of rape, while a judge said late Monday he would order the disbarred prosecutor to leave office immediately.

While this story has unfolded, few really doubted that Mike Nifong was going to end up in a world of trouble. It's nice to see that the judge agreed and ordered the prosecutor to cease his duties and leave.


I also doubt that prosecutorial misconduct is as rare as it should be, but it is one frightening aspect of dealing with the law. More out of paranoia than true 'respect for the law,' I am a pretty strict rule follower. Lord knows, I wouldn't want to spend a year of my life (or more) defending myself against false charges.


Of course, the Duke lacrosse players weren't exactly angels, if you've followed the history of their house - wild parties, underage drinking, strippers. So, don't feel too sorry for them. Had they not behaved the way they did, there would have been no opportunity for charges to be brought - true or false.


Their culpability notwithstanding, we are supposed to live in a society where everyone is innocent until proven guilty. There have to be checks and balances in place, so that one individual, like Nifong, does not have the power or authority to run roughshod over someone's civil rights and freedom.
